CXO Verse Policy

CXO Verse values your privacy and is committed to protecting your personal data. By using our platform, including mobile apps and websites (cxoverse.com and CXO Verse App)you agree to this policy.

We collect personal details (name, email, phone, company info), technical data (IP, device details), and usage data to improve services, personalize content, and ensure security. Your data may be shared with service providers, legal authorities, or in business transfers but is never sold or rented.

1.3 Additional agreements you enter into with CXO Verse may also apply. If there is a conflict between this policy and such agreements, the terms of the agreements will take precedence unless stated otherwise.

Capitalized terms not defined in this Privacy Policy or the Terms of Use shall have the following meanings:

2.1 Personal Information or Business Information – Any data related to an individual or company that can identify them directly or indirectly when combined with other available information. This includes names, addresses (home/work), email addresses, date of birth, voice, opinions, PAN, and similar details, unless publicly available.

2.2 Sensitive Personal Data or Information and Sensitive Business Information – Confidential company or personal data, including:
a. Passwords
b. Aadhaar details
c. Financial details (bank account, credit/debit card, or other payment information)

2.3 User Information – A combination of personal information, sensitive data, and any other information collected from you while using CXO Verse.

3. Collection of Information

Usage and Access
CXO Verse collects and processes user information only for the purposes outlined in this policy. Access to the platform requires registration with a username and password. Upon membership expiration, access to certain features may be restricted.

Prohibited Use by Minors
Minors are not allowed to use our services, and we do not collect their personal information.

You may decline to submit identifiable information through the platform, in which case You may not be allowed to access certain features / parts of the platform. If You are a registered user, You may update or correct Your account information and email preferences at any time by logging in to Your account. 7.2 The Information collected by Us shall not be retained for longer than is required for the purpose for which the information may lawfully be used or is otherwise required under any other law for the time being in force.

11. Payment

  • We use Razorpay for secure payment processing. Neither we nor Razorpay store your card details.
  • Payments are encrypted following PCI-DSS security standards to ensure safe transactions.
  • Your purchase transaction data is used only for processing the payment and is not stored afterward.

12. Storage and Security

12.1  Data Storage & Protection

  • We store all collected information securely within databases controlled by us, though some data may be stored with third-party hosting providers.
  • Our databases are protected by firewalls, and access is strictly password-protected.

12.2   Security Measures

  • We use commercially reasonable safeguards to prevent unauthorized access, loss, theft, or misuse of your information.
  • Sensitive Personal Data is encrypted using SSL (Secure Socket Layer) technology during transmission.

12.3   Data Transfer & Compliance

  • Your data may be stored or processed inside or outside India. By using our platform, you consent to this transfer.

12.4  Internet Risks & Liability

  • While we take strict security precautions, data transmission over the internet cannot be 100% secure.

13. Confidentiality

13.1  User Responsibility

  • Information provided voluntarily outside the Platform’s intended use (e.g., public forums) is considered non-confidential.
  • CXO Verse is free to use such unsolicited information without restrictions.

13.8  Third-Party Interactions

  • Any information shared directly with another user may not be covered by CXO Verse’s confidentiality terms.
  • CXO Verse is not responsible for data security in user-to-user exchanges, even if conducted through the Platform.

14. Indemnity

Users agree to indemnify and hold CXO Verse harmless against:

  • Third-Party Claims – Any claims, lawsuits, damages, penalties, or legal costs arising from the violation of this Policy.
  • Legal Violations – Any non-compliance with laws, rules, or regulations by the user.
  • Fraudulent Activities – Any fraudulent act committed by the user.

15. Severability

  • If any provision of this Policy is found to be invalid or unenforceable, it shall not affect the validity of the remaining provisions, which will continue to be in effect.

16. No Waiver

  • Rights and remedies under this Policy are cumulative and can be exercised as needed.
  • A delay or failure to enforce any provision does not constitute a waiver of rights, unless explicitly agreed upon in writing.

17. Governing Law & Dispute Resolution

17.2 Governing Law & Jurisdiction

  • This Policy shall be governed by and interpreted in accordance with the laws of India.
  • The courts in Gurugram, India, shall have exclusive jurisdiction over any disputes, subject to the arbitration provisions outlined below.

17.3 Dispute Resolution Process

  • Negotiation: Parties will first attempt to resolve any disputes through good-faith negotiations within 15 days of a written request.
  • Arbitration: If unresolved, disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996.
  • During arbitration, both parties must continue fulfilling their other obligations under the Terms of Use.

17.4 Arbitration Details

  • Sole Arbitrator: Appointed jointly by CXO Verse and the user. If not appointed within 30 days, an arbitrator will be designated per legal provisions.
  • Venue: Gurugram, India.
  • Language: English.

17.5 Confidentiality & Injunction Rights

  • Breaches of Confidentiality (Clause 13) may not be adequately remedied by monetary compensation.
  • CXO Verse has the right to seek specific performance and legal injunctions to ensure compliance with confidentiality obligations.

18. Foreign Jurisdiction

The rights and remedies available under this Policy may be exercised as needed and are cumulative, meaning they do not exclude any rights or remedies provided by law.

  • Any waiver of rights under this Policy must be in writing.
  • Failure or delay in exercising any right or remedy shall not constitute a waiver of that right or any other rights available under this Policy.

19. Changes to the Policy

  • CXO Verse may update this Policy periodically to reflect changes in its data protection and privacy practices.
  • In case of material changes, users will be notified via email (to the registered email address) or through a notice on the Platform before the changes take effect.
  • Users are encouraged to review the Policy regularly to stay informed about updates.
  • By continuing to use the Platform and its services, users consent to the terms outlined in the latest version of this Policy.

21. Acceptance of This Policy

By using the CXO Verse platform, you acknowledge that you have read and understood this Policy and agree to be bound by its terms and conditions.

  • If you continue to use the Mobile Application or its Services, it will be deemed as your acceptance of this Policy.
  • If you do not agree to abide by the terms of this Policy, you are not authorized to use or access the Mobile Application and its Services.
